Terms & Conditions

Please read the following T&C's carefully as they apply to all hired products. We've done our best to keep them as simple and clear as possible.

Definitions

"Hirer"

means any person who requests the Owner to hire Equipment to it, including its employees and agents.

"Owners"

means Epic Celebrate Timber, its employees and agents.

"Owners"

means Celebrate Timber, its employees and agents.

"Equipment"

means the items hired out by the Owner to the Hirer.

"Terms"

means these terms and conditions.

"Security Deposit"

means the amount of money to be paid prior to hiring of the Equipment to cover loss, damage or repairs as a consequence of the hire.

"Late Fee"

means the fee charged by the Owners to the Hirer for failure to return the Equipment on the agreed day and time.

"Hire Period"

means the booked and/or agreed days which the Hirer is/will be in possession of the Equipment including delivery, collection and return dates.

"Booking Confirmation"

means the document provided by the Owner confirming the Hire Period and Equipment for hire by the Hirer.

Agreement
  • The Hirer agrees to the terms and conditions of Celebrate Timber by checking the 'I agree to Terms and Conditions' box on the Cart page.
Hire Basis
  • Full payment is required at the time of booking. The Full Payment amount includes the total hire amount, plus the Security Deposit. These items will be documented on the Booking Confirmation for the Hirer. The Security Deposit will be refunded to the Hirer on the successful and safe return of the Equipment. Any damages, losses, breakage will reduce the Bond refund. All reductions to the Bond amount will be documented to the Hirer for clarification. When a discount code or voucher claim code is used to pay for the Security Deposit portion of a booking, the Security Deposit amount paid with a discount code or claim code will not be refunded to the Hirer.

    The Hire Period is chosen by the Hirer at the time of booking by selection of a number of days and a calendar start date. A day is taken to to be full calendar day or part thereof. For example a 2 day hire booking starting Saturday requires collection/delivery on Saturday and return Sunday.
Damage, Breakages, Loss and Care of Equipment
  • The Hirer must inform the Owner of any damage, breakage or missing Equipment on receipt of the Equipment at the beginning of the hire period. The Hirer will advise the Owner of any damage, breakages or loss of Equipment which occurred during the Hire Period at the time of the return of the Equipment. The Hirer will be charged an appropriate fee for the damage, loss or breakage of the Equipment. The Hirer's Security Deposit will be reduced by the amount determined by the Owner to be the cost of the breakage, damage or loss. If the amount exceeds the Security Deposit the Hirer agrees to reimburse the Owner the amount exceeding the Bond.

    Reasonable wear and tear is expected due to the nature of the Equipment and its intended use. Equipment is only to be used as per guidelines and playing instructions.

    Equipment must be returned dry, repacked in its supplied crate, bag or box and in reasonably clean condition. A cleaning charge may be deducted from the Security deposit for Equipment returned in excessively dirty condition.
Late Fee
  • A Late Fee will be charged for Equipment that is not returned as per the Hire Period unless agreed by the Owner prior to the return of the Equipment. The Late Fee is $50.00 per hire and will be deducted from the Security deposit.
Cancellation of Hire
  • The Hirer may cancel the hire of the Equipment providing written notification that the Equipment hire is no longer required at least 48 hours prior to commencement of the Hire Period. Cancellation of Hire within 48 hours of the commencement of the Hire Period will result in the forfeit of the security deposit unless the Equipment can be rehired for a equal or greater Hire Period covering the original hire dates. The Owner may cancel the hire at any time. The Hirer shall have no claims for such cancellation.
Delivery and Collection/Return
  • Delivery of Equipment is available to standard delivery areas, as per product description, for an additional fee via the Product page. Delivery outside the standard delivery areas may be arranged with the Owner by phone or email. A Hirer can choose to collect Equipment from the Epic Garden Games business address in Toowong at an agreed time or another address supplied by the Owner for no additional Fee.
Indemnity
  • The Hirer will assume the risk of and indemnity and hold the Owner harmless from and against any and all property damage and personal injury resulting from the use of the Equipment. The Hirer hereby releases the Owner from, and agrees to indemnify the Owner in respect of any third party claims, actions, demands, costs and expenses for damage or injury to person or property arising directly or indirectly out of the hire or use of the Equipment by the Hirer or these terms.
